Conditions of Sale
Price
The inclusive price of VAT is shown alongside the exclusive price for all products on the website apart from those in the specials and new bar. Prices do not include the costs for postage unless explicitly stated otherwise. The customer shall pay for all mentioned charges in respect to the supply of products. blinds-etc.co.uk reserves the right to change prices quoted in advertisements and price lists without prior notice.
Order Acceptance
All orders are accepted and products supplied subject to these express terms and conditions only. These terms and conditions prevail over the customers' terms and conditions of purchase. Any changes in these terms and conditions are only accepted by Blinds-etc.co.uk in writing and signed by Blinds-etc.co.uk.
Delivery
Time quoted by Blinds-etc.co.uk for delivery of goods is to be treated as an estimate only. Delivery may be postponed or delayed because of circumstances beyond Blinds-etc.co.uk control and Blinds-etc.co.uk shall not be liable for any damages or penalties relating to the/any delay in despatch or delivery. If products are not received then the customer must notify Blinds-etc.co.uk within 7 days of despatch. Blinds-etc.co.uk will only deliver to an address within the United Kingdom.
Payment Terms
Payment of product(s) ordered is due before despatch, unless otherwise agreed in writing with Blinds-etc.co.uk. Blinds-etc.co.uk shall be entitled in the event that the amount payable to it under any contract is overdue, without prejudice to any other right, suspend deliveries until such payment has been made.
Your right of cancellation
You (the customer) have the right to cancel the contract at any time up to the end of 7 working days after you receive the goods (see below). To exercise your right of cancellation, you must contact Blinds-etc.co.uk via email and await confirmation. If you exercise your right of cancellation after the goods have been delivered to you, you will be responsible for returning the goods to Blinds-etc.co.uk at your own cost. The goods must be returned to the address shown below. You must take reasonable care to ensure the goods are not damaged in the meantime or in transit. Once you have notified Blinds-etc.co.uk that you are cancelling the contract, Blinds-etc.co.uk will refund or re-credit you within 30 days for any sum that has been paid or debited from your debit/credit card for the goods. If you do not return the goods as required, Blinds-etc.co.uk may charge you a sum not exceeding the direct costs of recovering the goods. You do not have the right to cancel the contract if the order is for consumable goods that, by their nature, cannot be returned and resold.
Cancellation on the orders can only be accepted once it has been assertained that the goods have not been manufactured and that the manufacturers will accept cancellation.
Where cancellation is accepted the buyer will be responsible for 20% cancellation fee based upon the full retail value of the original order and invoice thereof.
Returns
Blinds-etc.co.uk is under no obligation to accept returns of goods that have been ordered in error or are no longer required by the Customer. Any return of goods must first be authorised by Blinds-etc.co.uk. Any goods returned without first being agreed will not be accepted and no refund or replacement shall be issued. Faulty goods diagnosed by Blinds-etc.co.uk have to be verified by the manufacturer within their specified time, in order to be replaced or repaired.
All carriage charges must be met by the client.
Warranty
All new goods supplied by Blinds-etc.co.uk are warranted free from defects for 12 months from the date of supply (unless otherwise stated). This warranty does not affect your statutory rights as a consumer. This warranty does not apply to any defect in the goods arising from fair wear and tear, wilful damage, accident, negligence by you or any third party, use otherwise than as recommended by Blinds-etc.co.uk, failure to follow instructions, or any alteration or repair carried out without Blinds-etc.co.uk approval. If the goods supplied to you are damaged on delivery, you should notify Blinds-etc.co.uk via e-mail. If the goods supplied to you develop a defect while under warranty or you have any other complaint about the goods, you should notify Blinds-etc.co.uk via e-mail within 7 days of the date you received the goods.
Force Majeure
If Blinds-etc.co.uk is prevented from, delayed or hindered (whether wholly or in part) in the performance of any warranty given by strike, lockout, trade dispute, Act Of God, war,' riot, explosion, fire, shortages of material, labour, transport or fuel, or without limiting the generality of the foregoing by other cause or consequence outside the company's direct control whether affecting its own business or that of any supplier or subcontractor, Blinds-etc.co.uk shall not be liable for any loss or damage (direct, indirect or consequential) to the Customer or any third party.
Applicable Law
These terms of sale and the supply of the goods will be subject to English law and the English courts will have jurisdiction in respect of any dispute arising from the contract.
